Actress fighting Charlie Sheen for child custody of twins

Actress Brooke Mueller is seeking to regain child custody of the twin boys she had with movie and TV star Charlie Sheen. The children are being taken care of currently by actress Denise Richard who took over caring for the children when Mueller entered a rehab program for substance abuse, which caused authorities to remove the children from her home.

A court proceeding later in June will determine who will ultimately get custody of the two boys — Mueller or Sheen or Richard. Sheen currently pays Mueller a total of $55,000 a month in child support and those payments, at least for now, have continued. Mueller’s mother, in a move believed to be calculated to help convince the judge that the Mueller household will be a good environment to return the boys to, has decided to move in with her daughter after the rehab program is completed.

Mueller’s mother has been given visitation rights since the children were temporarily placed in Richard’s care. Richard took care of the two twin boys during an earlier incident in which Mueller entered rehab for a time.

Mueller is currently in the Betty Ford Clinic. Sheen reportedly told Richard that he could give her some additional support money to help take care of his son, but she apparently turned down that offer.

The legal standard the judge must use to make the custody determination is what is in the best interest of the children. If Mueller does regain custody of her sons, child welfare authorities may well monitor her home to see if any further problems arise. All parties in the case will be represented by counsel who will attempt to convince the judge that their own client’s home would be the best environment for the children.
