San Antonio Spurs star believed to be divorcing

A divorce case filing is said to involve San Antonio, Texas Spurs basketball team member Tim Duncan and his wife, whom he wed in 2001. The court papers available to the public appear to have only the initials of the parties involved, indicating a desire for privacy for the proceedings.

The divorce was initiated approximately sixty days ago in Bexar County District Court. One indication that the basketball star is the party involved in the divorce are documents filed with the clerk of the court recently trying to hold off the process of legal discovery until the end of the basketball team's final playoff game. The request specifically mentions the team's playing schedule as the reason for the request. Additionally, the initials of the parties in the case match the player and his wife, and the date of the marriage listed matches theirs as well as the initials and birth dates of the two children listed in the documents.

The professional athlete is 37 and his wife is two years younger. The couple has two children, a son born in 2007 and a daughter born in 2005. The husband in the pending court proceeding seeks to enforce the terms of a prenuptial agreement the couple entered into prior to the marriage, as well as declaring that certain property be declared his and not part of the marital property to be divided because he owns it separately.

Prenuptial agreements can help protect the rights and property of a high asset individual, such as a professional athlete when entering into a marriage with someone with fewer assets. They can also be useful in protecting the interests of children born during a first marriage when a high asset individual subsequently remarries.
