Should I Move Out Now Or Wait Until My Divorce Is Final?

If your marriage in Texas is ending, you are faced with a wide range of choices. One of them will be to decide whether to stay in Texas or move out of the state. You then need to decide whether you want to move now or wait until your marriage is officially dissolved. There are some crucial facts for you to take note of.

Don’t move too soon if you have kids

Moving out of the home is one of the most common things to do during the divorce process. One of the parties will usually do so at the start of a separation. However, it’s one thing to do so while still staying close by so that you can attend the resulting court hearings. It’s a whole other to move out of state.

Leaving the state entirely is never a good thing to do before your divorce is final. Doing so can have a negative effect on your chances of getting a good settlement. If you have kids, this can harm your ability to gain full or joint custody. It may also increase the support payments you have to make.

Don’t pull up stakes before you divorce

Deciding to get a divorce is always harder when there are young children whose needs have to be considered. Moving out of state will make it a good deal harder for you to stay in the loop as your case proceeds.

Courts generally prefer parents to stay a reasonable distance from each other so as to facilitate custody agreements. If you move far away from the parent who has general custody, it will make it harder for you to gain access to your kids. Staying in the area, if not in the marriage, is your best bet.
