Obtaining A Protective Order
A protective order prohibits a person from having certain types of contact with other people named in the order. Violation of protective orders can result in criminal charges.
Obtaining a final protective order is a two-step process. You can obtain an immediate temporary protective order upon proper application to the court. Such temporary orders will expire within a couple of weeks, so a hearing for final order will need to be scheduled within that time.
At a hearing for a final protective order, the court will expect to hear evidence regarding the family violence that has occurred and why you believe that family violence is likely to occur again in the future. The Consequences Of Protective Orders
During the hearing, there may be a number of other issues to be decided. If the subject of the order must leave a joint residence, arrangements must be made for removing the person’s possessions from the premises. If the person retains parental rights regarding a child, a means to exchange the child must be determined. In a subsequent hearing, the parent may also lose his or her child custody or visitation rights.
